Menstruation when Umrah (Islamic Consultation) - If at the time we will take miqat umrah then women get the menstruation of how the arrangement of umrah in accordance with the Shari'a. There are women, after going to leave medinah get menstruation. She is still baths ihram circumcision then intends umrah in Bir Ali. If the party before returning home while the period is not sacred, what to do?
Answer:
Bismillah was shalatu was salamu 'ala Rasulillah, wa ba'du,
First, There are 3 terms that we need to recognize,
[1] Ihram: intention to perform the Hajj or Umrah (al-Mausu'ah al-Fiqhiyah, 2/129).
And when someone does ihram, he should pay attention to the rules and restrictions when ihram.
[2] Hajj: a series of certain worship activities in the land of unlawful, for a certain time.
[3] Umrah: a certain series of worship performed at the holy mosque, which includes thawaf, sai, and tahallul. (Fiqh Sunah, 1/749).
People who want to perform Haj or Umrah, are required to be in ihram condition. And ihram must be done outside the miqat. Like a person who wants to go abroad, he must have a visa before he entered another country. After a visa, he can go to the city of Mecca, to Medina, or to Jidda.
Secondly, one may do ihram for both Haj and Umrah in the condition of menstruation or great hadats. Since it is not required in ihram, it must be holy from both large and small hadats.
There are several propositions that confirm this,
[1] Hadith of Jabir ibn Abdillah radhiyallahu 'anhuma,
That when the Prophet sallallaahu 'alaihi wa sallam departed Hajj, when he arrived at Dzulhulaifah (Bir Ali - Miqat of Medina), Asma' bintu Umais (wife of Abu Bakr) gave birth to his son. then the Messenger of Allaah 'alaihi wa sallam ordered Abu Bakr to order his wife to bathe and intend ihram. (Muslim 1210)
When a woman gives birth, she will experience childbirth. And puerper women, in great hadats condition. But the Prophet sallallaahu 'alaihi wa sallam still ordered Asma' to continue ihramnya in order to hajj.
[2] Hadith of Aisha radhiyallahu 'anha
He told his experience when the pilgrim with the Prophet sallallaahu 'alaihi wa sallam
خَرَجْنَا مَعَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي حَجَّةِ الْوَدَاعِ . . فَقَدِمْتُ مَكَّةَ وَأَنَا حَائِضٌ وَلَمْ أَطُفْ بِالْبَيْتِ وَلا بَيْنَ الصَّفَا وَالْمَرْوَةِ ، فَشَكَوْتُ ذَلِكَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ : انْقُضِي رَأْسَكِ وَامْتَشِطِي وَأَهِلِّي بِالْحَجِّ
I joined the pilgrims 'pilgrimage with the Prophet sallallaahu' alaihi wa sallam .. when it came to Mecca, I experienced menstruation, so can not tawaf in the Ka'bah and not sa'i. I also denounce this to the Prophet sallallaahu 'alaihi wa sallam, he said, "Take off your bend, combat, and intend ihram for hajj." (Narrated Bukhari 1556 & Muslim 1211).
An-Nawawi said,
وفي هذا دليل على أن الحائض والنفساء والمحدث والجنب يصح منهم جميع أفعال الحج وأقواله وهيأته إلا الطواف وركعتيه فيصح الوقوف بعرفات وغيره
In this tradition it is proposed that menstruating, postnatal, hadats, and junub men legitimately perform all the practices of the Hajj, read their prayers, and the procedure except thawaf and do 2 rak'ats afterwards. They may do wukuf in Arafat or others .. (Syarh Shahim Muslim, 8/146).
From Ibn'Abbas radhiyallahu 'anhuma, the Prophet sallallaahu' alaihi wa sallam said,
الْحَائِضُ وَالنُّفَسَاءُ إِذَا أَتَتَا عَلَى الْوَقْتِ (أَيْ : الْمِيقَات) تَغْتَسِلانِ وَتُحْرِمَانِ وَتَقْضِيَانِ الْمَنَاسِكَ كُلَّهَا غَيْرَ الطَّوَافِ بِالْبَيْتِ
Menstruation and childbirth when arriving at miqat then he bathed and intend ihram, and can do all the manasik besides thawaf in the Kaaba. (Abu Dawood 1744 and al-Albani).
Therefore, for women menstruating, should still intend to Umrah when in Miqat.
Third, It is permissible for menstruating women to take menstrual preventive medication
This was once filed by Ibn 'Umar radhiyallahu' anhuma,
أن ابن عمر رضي الله عنه سئل عن امرأة تطاول بها دم الحيضة فأرادت أن تشرب دواء يقطع الدم عنها فلم ير ابن عمر باسا
That Ibn Umar radhiyallahu 'anhuma was once asked about a woman whose menstruation is long. This woman wants to take menstruation medication. And he judged no problem. (HR Abdurrazaq in Mushannaf, 1/318).
As long as the blood stops perfectly, this woman is considered sacred. So it's okay to do thawaf and prayer.
But if there is blood that comes out, though a drop, then the status of menstruation.
From Ibn Juraij,
سئل عطاء عن امرأة تحيض يجعل لها دواء فترتفع حيضتها وهي في قرئها كما هي تطوف
Atha 'asked about women who have menstruation, taking menstrual preventative drugs, until the menstruation stops, but it is in the period of time that became his habit, whether he may thawaf?
Answer Atha ',
نعم إذا رأت الطهر فإذا هي رأت خفوقا ولم تر الطهر الأبيض فلا
Sure, if he's sure his blood stops. But if he feels his blood is still there that came out though a drop and did not stop then not yet sacred. (HR Abdurrazaq in Mushannaf, 1/318).
Fourth, if the menstruation still does not stop until the return schedule, while it is impossible for him to remain there waiting sacred, what to do?
In this case there are 2 details:
[1] If it is possible for him to return to Mecca after the sacred to repeat Umrah, then he can temporarily return, and if it is pure, he returns again to Mecca for'Umrah. This condition is only possible for those living around Mecca or Saudi residents.
[2] If it is not possible for him to return, such as the outsiders, then this woman is in an emergency, so it is for her sacred menstrual requirements to complete her Umrah activities. That is, he may enter the haram, do thawaf, and sai in menstruation. But he must make sure to wear a sanitary napkin, so there is no blood on the mosque.
The above case was once asked to Lajnah Daimah. Answer Lajnah,
إذا كان الأمر كما ذكر من حيض المرأة قبل الطواف وهي محرمة ، ومحرمها مضطر للسفر فوراً وليس لها محرم ولا زوج بمكة ، سقط عنها شرط الطهارة من الحيض لدخول المسجد وللطواف للضرورة ، فتستثفر وتطوف وتسعى لعمرتها
If the problem is as mentioned, the woman experiences menstruation before the thawaf, and she is in ihram condition, while her mahram must safely do so, and this woman has no mahram and no husband in Mecca then fall for her sacred condition from menstruation to enter haram and tawaf because of dhurat. He has to wear sanitary pads, then do thawaf and sai for umrah.
Then Lajnah Daimah continued his explanation,
إلا إنْ تيسر لها أن تسافر وتعود مع زوج أو محرم ، لقرب المسافة ويسر المؤونة فتسافر وتعود فور انقطاع حيضها لتطوف طواف عمرتها وهي متطهرة ، فإن الله تعالى يقول : (يريد الله بكم اليسر ولا يريد بكم العس
Unless it is possible for him to safar and return to Mecca with his mahram or her husband, because the distance is near or the cost of safah is cheap, he can safar and immediately return when his menstrual blood has stopped, to do the Umrah thawaf in holy conditions. Because Allah says, (which means), "God desires slavery to you and does not want trouble for you" (Fatawa Islamiyah, 2/238).
